Our team was extremely busy across late 2021 and 2022 drafting the 9thedition of Focus: Family Law which was published in October 2022 by Lexis Nexis. Marlene Ebejer invited colleagues Victoria Byrne and Megan Aylett to join her as co-authors following the passing of the original author Eithne Mills in April 2021. Eithne maintained her authorship through to the 8th edition; a significant legacy. Eithne was, and continues to be, the soul and spirit of this publication. Her wisdom remains scattered throughout the pages of this edition and will no doubt continue in future editions.
This ninth edition provides extensive discussion of recent cases and policy, including the commencement of the Federal Circuit and Family Court of Australia in September 2021. Significant developments covered in this edition include:
- integration of the discussion on married and de facto property into one chapter
- habitual residence as a jurisdictional consideration for parenting applications under Family Law Act 1975 s 69E
- references to the newly commenced Federal Circuit and Family Court of Australia (Family Law) Rules 2021 updated throughout
- current Federal Circuit and Family Court of Australia practice and procedure following the 2021 court merger
- new family law procedures with respect to superannuation information as from April 2022
- important recent decisions, such as:
- Fairbairn v Radecki [2022] HCA 18
- Clayton v Bant (2020) 385 ALR 41
- Hsiao v Fazarri (2020) ALR 446
- Heaney & Gerethy [2021] FamCA 511
